Terms of Service
Effective June 11, 20261. Acceptance
By accessing or using ExhibitStampPro™ ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree to these Terms, do not use the Service.
2. Description of Service
ExhibitStampPro™ is a cloud-based litigation exhibit management platform that enables legal professionals to upload PDF documents, apply court-formatted exhibit stamps, track filing deadlines, and export exhibit packages. The Service is operated by ExhibitStampPro Ltd. ("Company", "we", "us", "our").
3. Intellectual Property — Your Data
You retain full ownership of all documents, data, and content you upload to the Service ("Your Content"). We claim no intellectual property rights over Your Content. You grant us a limited, non-exclusive license to process, store, and display Your Content solely to provide the Service to you. This license terminates when you delete Your Content or close your account. You represent that you have all rights necessary to upload Your Content and that doing so does not violate any third-party rights.
4. Intellectual Property — Our Platform
The Service, including all software, algorithms, user interface designs, trademarks (including ExhibitStampPro™, USPTO application pending June 11, 2026), and documentation, is owned exclusively by the Company and is protected by copyright, trademark, and other intellectual property laws. You may not reverse engineer, decompile, copy, modify, or create derivative works from any part of the Service.
5. Subscriptions and Payment
The Service is offered on a subscription basis. Fees are billed monthly or annually in advance. All payments are processed by Lemon Squeezy (our payment processor). Subscriptions automatically renew unless cancelled before the renewal date. Fees are non-refundable except as required by applicable law or as expressly stated in our refund policy. We reserve the right to modify pricing with 30 days' notice.
6. Free Trial
We may offer a free trial period. At the end of the trial, you must subscribe to continue using the Service. We reserve the right to modify or discontinue trials at any time.
7. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. You may not use the Service to process documents you are not authorized to handle, to circumvent any access controls, or in any manner that could damage or overburden the Service.
8. No Legal Advice
The Service is a productivity tool for legal professionals. Nothing in the Service constitutes legal advice. Court formatting accuracy is subject to local rule verification by counsel. We make no representation that exhibit stamps generated by the Service comply with the requirements of any particular court. You are solely responsible for verifying compliance with applicable court rules.
9. Data Security and Storage
We implement industry-standard security measures to protect Your Content, including encrypted storage via Supabase and secure transmission via TLS. Your documents are stored in private storage buckets accessible only to your account. See our Security page for details.
10. Confidentiality
We treat Your Content as confidential. We will not access your documents except to provide the Service, respond to support requests, or as required by law. Our staff are bound by confidentiality obligations. See our Privacy Policy and Subprocessors page for details on how data is handled.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service, Your Content, or your violation of these Terms.
14. Termination
Either party may terminate these Terms at any time. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to use the Service ceases. We will retain Your Content for 30 days after termination, after which it will be deleted. You may export your data at any time before termination.
15. Governing Law
These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Tel Aviv-Jaffa, Israel. Notwithstanding the foregoing, we reserve the right to seek injunctive relief in any jurisdiction to protect our intellectual property.
16. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
